GENERAL:
The goods ordered under this agreement are purpose-made specifically for the customer’s particular requirements, and hence are not resalable to third parties.
RIGHT TO TERMINATE:
The agreement shall not become binding to the company until it has been accepted by the company in writing. Upon such acceptance in writing by the Company (terms of which shall be set out in such acceptance) the agreement is not subject to cancellation (See Clause General)
TERMS OF PAYMENT:
Payment of the total price as shown in the confirmation (see Clause right to terminate), less deposit, shall be payable to the company`s installer immediately upon completion.
a) The customer must obtain as evidence of payment a signed receipt from the aforesaid installer.
b) Cheques, Money order and postal order shall be made payable to APPLESHOPFRONTS Ltd.
TIME OF PERFORMANCE - COMPANY
Every effort will be taken to complete the order within a reasonable period of time. The company however will not be held responsible for specific dates which have been affected by circumstances outside of its control.
TIME OF PERFORMANCE - CUSTOMER
The Customer agrees to give free access to the company’s work-men and supervisors to carry out all constituents of the said installation. If the required necessary access is not given within 30 days of the customer being notified in writing that the units are manufactured then the customer shall be liable to pay the company the cash balance (referred to in clause terms of payment above). Payment to be made within 7 days after the expiry of the 30 day trial period.
PASSING OF PROPERTY
All goods shall remain the property of the company until they are paid for by the customer.
DAMAGE:
Every care is taken to avoid unnecessary damage, although the customer accepts and acknowledges the normal problems which can occur when building works are affected to the property which is currently occupied. The cost includes making good to the immediate fitting area, i.e. the side and the top and the bottom of the window surrounds not redecoration of the parts of the shop, either inside or out. the company will not undertake to make good fittings, furnishing, decorations or walls, or any other parts of the premises. It is recommended that immediate areas of the shop affected are cleared of goods prior to installations of shopfront or shutters/grilles.
GLASS:
All glass used by the company shall be of a thickness and weight determined by the company`s technical surveyors, the company undertakes to exclusively supply approved Laminated Glass and the Customer Accepts that minute manufactures marks and sometimes be seen and are beyond the control of the company.
PLANNING PERMISSION:
It is the responsibility of the client to get the planning permission.
DISLODGED MATERIALS (RUBBISH):
It is the sole responsibility of the customer unless stated by the company, to take care and remove the dislodged materials.
